Pursuant to the Biden Administration’s changes to personnel law for federal employees, the Office of Personnel Management (OPM) has just issued new proposed regulations to rescind many of the prior Administration’s federal employee rule changes. The changes by OPM were those put into motion earlier this year when the President revoked Executive Order 13839 by signing Executive Order 14003. The President, in Executive Order 14003 directed OPM to suspend, revise, or rescind actions implementing Executive Order 13839.

OPM’s new rules will affect federal employees in a few ways and will likely be fully implemented as soon as the short comment period is over. The changes will eliminate the clean record settlement ban, alter performance-based actions, revise probationary period notices, and change a few other personnel issues for federal employees. By far, the most important change is the ability for federal agencies to enter into clear record settlements with federal employees in cases.

Major Changes for Federal Employees

OPM’s proposed rules will rescind several parts of the former Administration changes to civil service rules, including the following:

  • Clean Record Settlements: This is the change that everyone has been waiting for. The prior Administration banned federal agencies from resolving federal employment litigation involving clean record settlements, where a person would be able to obtain a fresh start as part of settlement. Both federal employees and agencies disliked the ban because it interfered with their ability to resolve cases. The proposed changes will eliminate this ban and allow federal agencies the discretion to resolve complaints and settle cases in a fair manner.
  • Performance-Based Actions Against Federal Employees: The former Administration’s prior rule added language that basically left struggling employees without the ability to obtain assistance in successfully passing performance improvement plans. OPM’s change in the proposed rule would revert back to prior language that provided that as “the agency shall offer assistance to the employee in improving unacceptable performance” during the performance improvement plan process.
  • Probationary Notices: Next, OPM’s former rules required federal agencies to notify supervisors at least 3 months before an employee’s probationary period ended (with an additional reminder 30 days before it ended). The rules also required supervisors to make an affirmative decision about whether the employee should stay on the job. The rule had the unintended effect of causing many unjustified terminations and confusion. OPM’s new rules will remove this requirement because it believes that the frequency and timing of notifications should be left up to the discretion of each agency.
  • Disciplinary Penalty Determinations: The proposed rule removes many of the former Administration’s new criteria for disciplinary penalty evaluations, restating that a belief that the Douglas factors govern penalties for federal employees, leaving significant discretion to federal agencies.
  • National Guard Technician Changes: The proposed rules also would implement new requirements for procedural and appeal rights for dual status National Guard technicians for certain types of adverse actions.

COVID-19 did little to slow the Reston real estate market. Gains through 2021 were significant, we exceeded $800 million in volume and did 1559 transactions. The average sales price was $530k and the average days on market was 19.

While the Fed has been signaling that there will be rate increases, lenders are saying they expect rates to land in the high 3%’s to low 4%s; certainly higher than they have been, but still remarkably affordable by most measures.

In Reston expect a strong, early spring market. Low inventory will continue to drive fast contracts and low days on market. Those sellers who heed their agent’s advice for preparing and pricing their property will likely be rewarded with multiple offers.

The Buffalo Wing Factory at Hunters Woods Plaza has been open since 2005, but you have never seen it like this. The popular, action-oriented sports bar and restaurant has enjoyed a substantial refresh with a renovation — from hoof to horns, inside and out — that is finally finished and ready to show off the famed chain’s Reston outlet’s new look.

The revamped restaurant’s new menu includes a smorgasbord of what they call “well-crafted comfort food,” which includes their popular “smashburgers” (two seasoned patties that are smashed and seared on the grill), hip new takes on classic sandwiches, oversized salads, and a full-line of pizzas, including the Upstate, which adds grilled buffalo chicken and a drizzle of ranch dressing to the pie.

Did we say buffalo chicken? Buffalo Wing Factory still boasts its namesake Buffalo, New York-style wings, in some 25 flavors and four different heat intensities, ranging from mild to the “torrid zone,” which it is advised to enter into with caution.

Along with “well-crafted comfort food,” Buffalo Wing Factory also features well-crafted beer, with an elongated list of popular domestic beers and rotating selection of special label and local suds on draft. The cocktail menu has also been re-done for those who enjoy spirits with their wings and sports.

Reston architectural aficionados know that Reston architect Ken Bonner built the first house in South Reston — a detached single-family house on Stirrup Road.

Ken once recalled having to transport a portable generator to the building site because there were no power lines yet. This was back in 1964. Integrating a human living space into nature in an environmentally sensitive way was his passion. In the 1960s, Reston founder Robert E. Simon Jr. was eager to give Ken a chance to build throughout Reston with that philosophy in mind.

Ken built about 65 homes in Reston, including the one where I raised my children. Mine was on the other side of Reston on Buttermilk Lane in the Uplands neighborhood of North Reston. I loved that house and the neighborhood. It backed up to a beautiful, treed lot with a creek at the bottom of the backyard. We kept the walls painted bright white and let the color of the woods in through the wall of windows that ran across the rear of the house. It was a fantastic place to raise our family. Much of that has to do with Bonner’s design philosophy.

What is lesser known in Reston is that Ken also designed townhome communities. Among them, Colts Neck Cluster. This community is comprised of 60 townhouses in South Reston, near the intersection of Colts Neck Road and South Lakes Drive. Escalante Court is off South Lakes Drive and next to the South Lakes Drive Park. Greywing Court is off Colts Neck Road.

Built in 1972-1973, these contemporary townhomes are three levels with cedar siding exteriors. The 1,600 to 2,000 square feet homes feel much larger because of Ken’s attention to every detail.

The Colts Neck community is close to the Reston National Golf Course and the Hunters Woods Village Center Shopping Center. It is also within two miles of the Reston East Metro station.

These lovely homes are not only perfect for anyone looking for well-designed, contemporary architecture in a close-knit, townhome community, they represent a piece of what makes Reston such a great place to live.

Nothing gives your home personality or creates a mood more than paint. Last year’s trends were all about colors inspired by nature to help calm and soothe after the stresses of lockdown and our need to leave 2020 behind us. With many of us still working from home and spending time in our nests, paint remains high on the priority list of changes homeowners want to make in their space. This year, it’s all about renewal but keeping a sense of warmth and home as the central focal point. So, grab a coffee and let’s take a look at what some of the biggest names in the industry have chosen as their color and/or color trends for 2022.

Benjamin Moore

We love Benjamin Moore paint and use it in most of our home remodels, so they get our first color shout out for 2022! This year, they’ve named October Mist (1495) as their top pick. We like the delicacy of the description, “Evocative of the stem of a flower, this gently shaded sage anchors and uplifts.”

According to Nivara Xaykao, Associate Manager of Color Marketing and Development at Benjamin Moore, “We homed in on October Mist because it felt so fresh in the moment, but it also has a timeless quality. It’s distinct enough to make an impression on its own, but then it’s subtle enough to pair with so many other colors.”

Farrow & Ball

For their 2022 picks, Farrow & Ball have chosen five different colors: Breakfast Room Green, Stone Blue, School House White, Babouche and Incarnadine. We never get bored of their creativity when it comes to naming paint!

According to the company’s long-serving color curator, Joa Studholme, “There is something inherently human in the colors that we are attracted to for 2022 as well as in the way we use them. They are an eclectic mix of the pure and the humble that evokes the warmth and harmony of a more innocent age while celebrating life today. Function goes hand in hand with ornament, using colors and finishes in unusual ways to celebrate the principles of utility, kindness and honesty.”

In simple terms, that means they are scaling things back to a simpler time but with a fresh twist that celebrates present times.

In keeping with the botanical inspired tones, Sherwin-Williams has chosen Evergreen Fog (SW 9130) as their Color of the Year. According to the company, Evergreen Fog is “soothing, subtle and a perfect shade to freshen up any space” that is “a versatile and calming hue, a chameleon color of gorgeous green-meets-gray, with just a bit of blue. It’s a simple but sophisticated wash of beautiful, organic color for spaces that crave a subtle yet stunning statement shade.”

The Merit Systems Protection Board (MSPB) is an appeals forum for federal employees and former federal employees to challenge various types of federal agency actions, such as serious disciplinary actions (adverse actions), retirement appeals, whistleblower matters and other types of cases. The most usual type of appeal for federal employees involves filing an appeal over a serious disciplinary action, such as removal from the federal service.

During an appeal a federal employee can choose to be represented by an attorney or not be. In almost all cases, however, the federal agency will be represented in the appeal by an attorney. This article discusses some of the reasons for retaining an attorney familiar with the MSPB process to assist you in an appeal. In other words, the reasons why it is important for a federal employee to retain an MSPB attorney. Here are some reasons why it is important for a federal employee to retain an MSPB lawyer for their appeal.

Federal Agencies Treat MSPB Cases Differently When an Employee Has an Attorney

One of the reasons why it is important to have an MSPB experienced attorney representing a federal employee is that it will very likely make a difference in how the federal agency treats the MSPB appeal at issue. Federal agencies allocate their attorney resources first to cases where an individual has their own attorney. Those cases tend to get the most attention because there are attorneys on both sides of the appeal.

In other words, where an appellant has their own attorney, the federal agency involved will focus more on that individual’s appeal merely because they have an attorney. This focus can help to settle MSPB appeals.

The MSPB Process is Much Like a Regular Court Case

One of the most important reasons why it is important to have an MSPB attorney represent a federal employee in the appeals process is the fact that it is a very serious type of appeal, functioning much like a court case. There is a general misperception that the process is designed for an employee to effectively represent themselves. An MSPB appeal functions much like a civil court case where there is discovery, the taking of depositions and the filing of briefs.

It is critical that an appellant have counsel to assist them in these difficult and sometimes complex processes. It is often the case where federal employees discovery this fact late and we are contacted after discovery deadlines have passed which can make appeals much more difficult to prevail in and/or settle. It is important to have an MSPB attorney early in the process.

There have been at least 10 states that have legalized marijuana over the past 5-10 years. The change in state laws has led to significant confusion by security clearance holders about their ability to use marijuana while holding or seeking a security clearance.

States like Massachusetts or California have legalized marijuana, but marijuana use remains illegal under federal criminal law as a Schedule I drug. The state and federal conflict in laws has caused both confusion and problems for security clearance applicants or holders.

Security Clearance Rules Governing Marijuana Usage

Security clearance holders and applicants frequently run into security clearance problems under Guideline H of the Security Clearance Guidelines (Security Executive Agent Directive 4) because they don’t realize that the use of marijuana, even in a state that has legalized it, remains illegal under federal law.

I believe that these guidelines will be amended in the next 5-7 years to change the use of marijuana from a complete ban to an abuse standard, like with alcohol, but the issue remains a problem today for those in the security clearance world.

Additionally, the type of marijuana which is used makes no difference (e.g. candy form, chocolate, brownie, smoking) under the guidelines. We have seen individuals that have had security clearance problems stemming from eating a single gummy candy which contained the active ingredients of marijuana.

We have defended many security clearance clients who have engaged in the light (or even one-time) usage of marijuana, who have had difficulties in overcoming the presumption that even minor use makes one ineligible to hold or maintain a security clearance. If the usage was a long time ago, this can significantly help mitigate a security concern, but the trickiest situations arise when marijuana usage has occurred within the past year.

The key in such cases is to attempt to mitigate security concerns by showing abstinence, changes in attitude, changes in associations with friends that engage in drug use and counseling, where needed.

Guideline H of the SEAD 4 states that:

The illegal use of controlled substances, to include the misuse of prescription and non-prescription drugs, and the use of other substances that cause physical or mental impairment or are used in a manner inconsistent with their intended purpose can raise questions about an individual’s reliability and trustworthiness, both because such behavior may lead to physical or psychological impairment and because it raises questions about a person’s ability or willingness to comply with laws, rules, and regulations. Controlled substance means any “controlled substance” as defined in 21 U.S.C. 802. Substance misuse is the generic term adopted in this guideline to describe any of the behaviors listed above.

Thanksgiving is my favorite holiday because it brings everyone together, especially in the kitchen which is the heart of the home.

This year, try making some cocktails to complement your Thanksgiving dinner that kids and adults can enjoy. Read below for my favorite recipes including one invented by my family!

For the Adults

  • Ginger Bourbon Cider

4 cups fresh apple cider
4 cups ginger beer (World Market is a great place to buy ginger beer)
12 oz. bourbon
Ice
4 tsp white sugar
1 tsp cinnamon
Maple syrup

Mix cider, ginger beer and bourbon together in a pitcher. Pour a small amount of the maple syrup onto a plate. Mix sugar and cinnamon on a separate plate. Dip inverted glasses onto the syrup followed by the cinnamon sugar mixture. Pour ice into the glasses and top with the cider. This is also delicious served hot!

  • Napalitos (invented by my father-in-law and I)

1 bottle Italian wine such as Montepulciano
½ bottle dry white wine such as Pinot Grigio
2 cinnamon sticks
1 clove
1 orange cut into slices

Pour all ingredients into a saucepan and simmer on low for 20 minutes. Serve in tea cups or small coffee mugs using the warm orange slices as a garnish. Easy!

For the Kids

  • Shirley Temples

1 liter ginger ale or 7 Up
½ cup grenadine
1 lemon cut into wedges
Maraschino cherries for garnish

Mix soda and grenadine into a pitcher. Pour over ice in small glasses, garnish with the cherries and squeeze the lemon into the mixture for a slightly sour finish. Also good with a splash of lemonade; the acid of the lemons cuts the sweetness of the drink.

  • Apple Pie Punch

4 cups 100% apple juice (no sugar added)
1 cup white grape juice
3 cups ginger ale or ginger beer (non-alcoholic) — ginger beer is tangy and less sweet than ginger ale
1 diced apple or sliced apples for garnish

Love it or hate it, the nights are getting darker and winter is on it’s way which means you are either looking forward to cozy nights in or are already thinking about the best places to go to catch some sun.

Either way, it’s the time of year when our attention turns to getting ready for the holidays and entertaining once again — and there’s nothing that creates ambience and a feeling of ‘home’ during the long winter months more than your fireplace.

It’s often one of the things that’s last on the priority list, but updating your fireplace can make or break how a room ‘feels’. So, if yours is a bit tired and you’re ready for an update, let’s take a look at some easy updates that will help your fireplace shine!

Wood Accents

It’s amazing the difference the use of natural elements can make in the design of a room. Wood brings the outside in, helps ground the space and, when used in the right way, is the perfect way to blend finishes together. Wood feels right at home with both transitional and contemporary design.

In this recent home remodel in Reston, the fireplace in the family room was nice but, with nothing to break up the floor to ceiling height and bulky look, the stone overpowered the room. By making a few simple changes such as adding a new wooden mantel and adding a custom niche with wooden shelves (seen on the left on the ‘After’ photo below), the fireplace now takes on a whole new feel and provides visual interest. The original wood-burning fireplace was also converted to gas.

Stone

For their recent home remodel, Synergy’s owners, Mina and Mark Fies, were ready to upgrade the old fireplace in their primary bedroom suite. They opted for PrecisionFit™ Onyx stone by ProVia to cover the former plain brick exterior for a linear, contemporary look.

Although ProVia stone may be better known for exterior applications, it is a great option for indoor projects like wall accents and fireplaces because it installs easily and quickly.

Electric Fireplaces

Don’t write off electric fireplaces. Personally, we LOVE the look and flexibility an electric fireplace can provide. In this basement remodel in McLean, the basement rec room previously felt cold and the off-set fireplace was awkwardly placed. Enter the “Sideline Elite” recessed electric fireplace by Touchstone! The fireplace now provides a cosy central focal point with the T.V. placed above it — complete with theater chairs for family movie nights!

Tile 

The use of tile on a fireplace facade is a simple and effective way to easily update your room without having to replace everything else.

As part of this home remodel in Vienna, we updated the fireplace in the family room for a more transitional look. The old stone which, in this case, dated the room was replaced with marble tile in a herringbone pattern. The wood burning fire was replaced with a Heat & Glo gas fire from Fireside Hearth & Home. The bookshelves and cabinets were not replaced, but the new fireplace gives them a whole new lease on life.

Get Creative!

Fireplaces don’t always have to be in the Family Room or Basement. As a unique design feature, Mina and Mark Fies decided to remove an old gas fireplace in their family room and install a Touchstone “Sideline Elite” electric fireplace in their kitchen island instead. This allowed them to reclaim space in their family room and change the overall flow of the entire space.

In addition to providing visual appeal, electric fireplaces are practical, too. They are a great way to effectively and safely heat a room. Read more about Mina and Mark’s design choice here.
